Terms of Trade

These terms of trade apply to the use of FindArt and to the buying and selling of art via the platform. By creating an account you accept the terms.

FindArt as a platform and intermediary

FindArt is operated by [VIRKSOMHEDSNAVN], company reg. no. [CVR-NR], [ADRESSE]. FindArt is a marketplace that facilitates contact between artists (sellers) and buyers. FindArt is not itself the seller of the works and is not a party to the purchase agreement itself, unless otherwise expressly stated. The purchase agreement is concluded between the buyer and the individual artist.

The artist as seller

The individual artist is the seller of their works and responsible for ensuring that the information about the work is correct, that the artist holds the necessary rights, and that the work is original in accordance with the artist's originality declaration. The artist sets the price themselves. FindArt charges a transparent commission on the sale.

Payment

When the payment function is active, payment is completed securely via our payment provider (Stripe). FindArt does not store your full card details. Amounts are stated in Danish kroner (DKK) including any fees, which are disclosed before the purchase is completed. A work can only be bought once it is greenlit.

Delivery

When the delivery function is active, shipping is calculated at checkout via our shipping partner (Shipmondo), and a shipping label is created upon payment. Delivery time and price depend on the destination and shipping method and are disclosed before purchase. The risk for the work passes to the buyer upon delivery.

14-day right of withdrawal

If you are a consumer, you generally have a 14-day right of withdrawal from the day you receive the work, under the Danish Consumer Contracts Act. Within the deadline you must give unambiguous notice that you are withdrawing, to the artist or to [KONTAKT-EMAIL]. You bear the cost of returning the item yourself and are liable for any diminished value of the work resulting from handling other than what was necessary. Note: the right of withdrawal may be limited for goods made to your specifications or with a clear personal touch (e.g. commissioned works).

Returns and refunds

If you withdraw in time, the purchase amount is refunded without undue delay and no later than 14 days after we have received your notice; however, the refund may be withheld until the work has been received back, or you have documented that you have returned it.

Liability

FindArt facilitates transactions and is not liable for the artist's fulfilment of the purchase agreement beyond what follows from mandatory legislation. FindArt is not liable for indirect losses or consequential damages. The right to complain under the Danish Sale of Goods Act applies vis-à-vis the seller. FindArt removes works upon a justified notice of infringement of rights, in accordance with our copyright policy.

Disputes and jurisdiction

Disputes are sought resolved amicably. If you are a consumer, you can complain via the Centre for Complaint Resolution and the Danish Consumer Complaints Board (Forbrugerklagenævnet) (Nævnenes Hus, naevneneshus.dk) or via the European Commission's online dispute resolution platform. Any legal disputes are decided under Danish law before the Danish courts.
